Property rights are not a lawful defense for using deadly force in Colorado, and the state’s so-called Make My Day law, which sets lower standard for using force, applies to households, not businesses.

Looks like some reform is needed in CO laws. Hyped up speed freaks with knives are just as much a threat at a business as in a house. They got what they deserved in my opinion.

So I disagree from a morale standpoint, and agree from a legal standpoint. You cannot take the law into your own hands without punishment, it negates the laws being passed in the first place.

#269493 This all depends on the situation and if ones life is in real danger which looks like it wasn't but then who knows what really happened besides someone dying.

#269521 So the theif actually had a run of stealing before he was shot ....did the police do anything there no so lets see when the police dont protect then what are you suppose to do the people didnt plan on killing a man but to be honest in my view wtf are they thinking i woulda just took a aluminum bat to the head and put him in a coma or something that way he isnt dead and he will be charged and put into jail for attempted auto theft and auto theft

i mean come on really? and who thinks the family of this man knew he was stealing cars and didnt once try to stop him or anything like that?

#269583 People will never learn. Yes he deserved to die, and I wish every other little drug addict, fuck up of society should just follow in those footsteps. The world would be a much better place.

#269624 I'll catch flack for this, I know...

Since he did not physically threaten then men at the dealer lot, and since he was hiding in a shed, he was not necessarily in the wrong. YES, he hopped the fence with full intent of theft, potentially grand theft, but he only had a couple of knives.

What the men with firearms should have done is corner him, and call the cops. That way the would be thief would have been charged with criminal trespassing, use of illicit substances, possession of illicit substances or paraphernalia...

I do support gun rights. I do support protecting your personal property and your person/family. I do NOT support staking out in a building waiting for a thief so that you can shoot at him/her. That could potentially be considered premeditated murder if a jury/DA/prosecutor wanted to pursue that charge.

The point of firearms for a law abiding citizen is for defense, not attack.

#269697 Hmmm, imagine that, they were immigrants who would rather steal than earn their living, haven't heard that one before.
Sounds like his family used the three year old to get a sympathy ruling and got a nice fat payday out of it as well.
I will say this though, it could have been handled differently, the "gunmen" acted hastily and almost came across as trigger happy, although I can understand them being very pissed after multiple break ins and robberies.
Personally I think a good beat down would have been more effective than killing him, give him something to ponder the next time he thinks about robbing somebody.

#269749 I think you miss read the post. The men who were breaking in were your typical Colorado white boy meth heads. The "gunmen" were Yugoslavian immigrants who fled to the US and were trying to make an honest living.

#269825 Look at it this way though; they said that the crime didn't fit the punishment, but when you truly look it at I think it does. They took the life of a carjacker before he took there lives. No, I don't mean by killing them, I mean by getting there business shut down. When you put everything you have into a business just for someone to come and steal from ut you want to kill them because that IS your source of income, your job, and your life. So I feel he deserves it and all of these stupid cases that seem to be winning today would have been laughed at back in the day. God damn I wish it was still like that at times.

I see, my bad.
My opinion about the robbers remains the same though, they did deserve it.

#270322 This is goin to open the flood gates now if someone is stealing you hard earnd stuff you are supost to wait 15-20 min for the cops to arrive and let them take your stuff . Thats crazy who wouldnt protect there stuff? I would feel no remorse for him if he was there to steal what I worked for. Justice was served one less criminal to worry about

#270750 I hate shit like this. Plain and simple the guy was coming to rob the house. If you make into my house or yard and I catch you....i'm gonna beat your ass and ask questions later. I mean what fucking judge and jury would award something like this. Its retarded and crap like this is making our justice system a freakin joke if you ask me. I think maybe killing the guy was a bit much, but in the same respect you are entering an unknown house....you are asking to get blown away. You dont know what people have...the guy was a moron :x
